By joining The Brackets Club, you acknowledge and agree to be bound by all of the following terms and conditions (“Terms”), and any additional terms and conditions that may be applied from time to time (collectively, the “Agreement”). If you do not agree to be bound by this Agreement, do not join The Brackets Club. The Brackets Club, Inc. (“TBC” or “us” or “our” or “we”) operates The Brackets Club. TBC reserves the right to modify or terminate The Brackets Club at any time and in any manner, in whole or in part. You agree that you will review these Terms periodically and that you are bound by this Agreement and any modifications we may make to it from time to time.

A. Membership

As a member of The Brackets Club, you have the ability to:

• Access to the private Slack group with TBC members
• Access to new opportunities for earning
• Access to getting funding through TBC in times of need

Your membership is non-transferable, non-refundable, and may not be resold.

B. Eligibility

The Brackets Club is open to all with the exception of those who are residents of the Quebec province of Canada, Iran, Cuba, North Korea, Crimea Region of Ukraine, Russia, Sudan or Syria. In addition, you are not eligible to participate in The Brackets Club if you are on the Specially Designated National list promulgated and amended, from time to time, by the United States Department of the Treasury.

Membership is subject to this Agreement, as well as any policies and procedures that TBC may have, adopt or modify from time to time. Any failure to abide by this Agreement or any policies or procedures implemented by TBC, any conduct detrimental to TBC, any misrepresentation or fraudulent activities in connection with your membership, or any failure to act in a manner consistent with federal, state, provincial, or local laws, regulations, or ordinances, may result, in addition to any rights or remedies available to TBC in law or equity, in the termination of your membership, as well as any other benefits earned in connection therewith, in TBC’s sole discretion.

C. The Brackets Club Code of Conduct

The Brackets Club is a place for networking, connection, opportunities, and friendship.. 

Treat everyone with respect. Absolutely no harassment, witch hunting, sexism, racism, or hate speech will be tolerated.

No Advertising. No spam or self-promotion (server invites, advertisements, etc) without permission from a staff member. This includes DMing fellow members.

No NSFW content. Anything involving gore or sexual content is not allowed. NSFW = Not Safe for Work. That includes profile photos, emojis, etc.

No spamming in channels. Do not spam messages. Spamming gets blocked by the bouncer. We do not care for this kind of energy.
 
No malicious content. No links to viruses, crash videos, or spamming others in DM. 

If you see something against the rules or something that makes you feel unsafe, let the admins know. We want this server to be a welcoming space.

D. Dues, Fees and Renewals

The Brackets Club is an annual membership. By accepting these terms, you agree to be a member for one (1) year. Your membership shall expire twelve (12) calendar months from the effective date of activation and may be renewed on an annual basis.

By joining The Brackets Club, you agree to pay a minimum of $30 as a tax exempt donation to our Fundly page: https://fundly.com/the-brackets-club for the amount of $30, including any applicable state, county, or local tax and service charges.

E. Cancellation

We may terminate membership for cause at any time. If you violate the code of conduct in any capacity, your membership may be suspended, or canceled for cause.

It is understood and agreed that if we revoke your membership privileges with cause, or if you resign, no refund will be made. Termination of membership shall be a full and complete release of TBC and all liability, claims, demands, actions or cause of actions arising out of, or related to, your payment of dues or membership status.

F. Privacy

Your information may be used by TBC, and their partners and assignees to facilitate your membership, and to communicate with you regarding your membership and offers from TBC, and their partners and assignees.

G. Disclaimer & Limitation of Liability

TBC MAKES NO WARRANTY OF ANY KIND REGARDING TBC MEMBERSHIP, WHICH IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY THAT TBC MEMBERSHIP WILL BE ERROR-FREE. TBC FURTHER DISCLAIMS ANY WARRANTY AS TO THE ACCURACY, COMPLETENESS AND TIMELINESS OF ANY CONTENT OR INFORMATION DISTRIBUTED WITH RESPECT TO THE CLUB MEMBERSHIP. WE EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS, INCLUDING IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE OF TRADE. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS WARRANTY DISCLAIMER MAY BE LIMITED IN ITS APPLICABILITY TO YOU. IN NO EVENT SHALL TBC BE LIABLE HEREUNDER FOR INCIDENTAL, SPECIAL, INDIRECT, CONSEQUENTIAL, OR PUNITIVE DAMAGES EVEN IF ADVISED IN ADVANCE OF THE POSSIBILITY FOR SUCH DAMAGES. TBC’S TOTAL LIABILITY FOR DAMAGES UNDER THIS AGREEMENT SHALL BE LIMITED TO FOUR HUNDRED FIFTY FOUR AND 87/100 DOLLARS ($454.87).

H. Modification

We reserve the right at all times to discontinue or modify any part of this Agreement, as we deem necessary or desirable. Additionally, we reserve the right at all times to add or remove services or to discontinue TBC Membership. We suggest that you review these Terms from time to time to ensure that you are aware of any updates we make to these Terms.
